I have the honour to acknowledge the receipt
of Your Lordship's despatch No.27 of 29th January on the subject of the additional pay drawn for the performance of two separate offices by Cadet Officers.

In view of the difficulty pointed out in Sir Cecil Clementi's despatch No.511 of 28th November, 1929, of fitting the conditions under which Cadet Officers serve into the rules for half-pay I propose in future cases, in which a doubt may arise, to refer the matter for Your Lordship's decision before payment of any extra emoluments.

In the cases of Mr. E. H. Williams and Mr. N.
L. Smith referred to in your despatch under reply I would request Your Lordship's approval for allowing the payments already made to stand without calling for a refund.
If a refund is to be insisted upon the same should properly apply to a number of similar payments over many years which, not having been questioned at the time, were considered to be
precedents for the two cases now specially mentioned.
